1. Introduction

Welcome to the website of the Aetherlight™ game (“The Aetherlight”) created and run by Scarlet City. These terms contain our privacy policy (“Privacy Policy”), which sets out important information about how we collect information obtained from you in your use of this website (the “Website”) and The Aetherlight, including the software, documentation and any associated materials comprising or made available to you via the Website or the Aetherlight (the “Materials”), as well as any services offered or provided to you by us or our nominated third parties via the Website or the Aetherlight (the “Services”). By making use of any of the Website, Aetherlight, Materials and Services, you are deemed to have read and agree to be bound by this Privacy Policy.

This Privacy Policy also discusses our privacy practices with respect to children under the age of 13, and the measures we take to comply with the U.S. Children’s Online Privacy Protection Act (“COPPA”).  To learn more about COPPA, please refer to this simple one-page informational guide from the kidSAFE Seal Program.  

2. Collecting Information

Whenever you access or make use of any of the Website, Aetherlight, Materials and Services, we may as applicable collect the following types of information from you:

(a) The lP address of your machine when connected to the internet;

(b) The operating system and the browser your computer uses and any search engine you are using;

(c) The date and time you are visiting;

(d) The URLs of the Website pages you visit; and

(e) Information relating to the actions you undertake within the Website and the Aetherlight,

as well as any other information you may explicitly provide us in the course of accessing or making use of any of the Website, Aetherlight, Materials or Services.

3. Further Collection

Where possible, information will be obtained directly from you.  However, you acknowledge that by accessing or making use of any of the Website, Aetherlight, Materials or Services that information may also be collected from you as a result of the workings of the Website, Aetherlight, Materials or Services as applicable and the attached systems and software.

4. Do we collect information from you to use or register on our site?

Registration for an account is required to access or make use of any of the Website, The Aetherlight, Materials and Services. For any child who registers on our site we collect the following specific information:

(a) Parent email address (for contacting parents about their child's account and to obtain their approval of their child’s registration);

(b) User name chosen for the account; and

(c) Password chosen for the account.

We also collect the type of information specified in Section 2 above when a child accesses any of the Website, Aetherlight, Materials or Services.

An email will be sent to the provided parental email address when a child registers for an account requesting the parent approve the creation of the child’s account and if such parental consent is not granted within 7 days of account creation, the child’s account and all associated information will be deleted. By approving a child’s account the parent is also deemed to be agreeing to the terms of this Privacy Policy.

If you wish us to delete your child's account at any point, please email us directly at support@theaetherlight.com.

We will not collect from a child more information than is reasonably necessary to provide the child with access to and allow them to make use of any of the Website, Aetherlight, Materials or Services.

5. What types of parental controls do we offer parents?

We offer the following types of parental controls and functionality:

(a) Deactivate child’s account by emailing support@theaetherlight.com and deleting “personal information” associated with child’s account and discontinue further collection or use of the child’s personal information;

(b) View “personal information” associated with child’s account; and

(c) Other controls include parental ability to turn Chat (see Section 7 below) on and off.

Parents can request that any of the above actions are taken by emailing support@theaetherlight.com - though dashboard functionality to allow parents to do this directly will be available from March 2016.

6. Use of Information

We use the information provided by you or generated by your accessing or making use of any of the Website, Aetherlight, Materials or Services to provide you the services we provide in relation to any of the Website, Aetherlight, Materials or Services.  We also use information collected from you to assess the performance of the Website, Aetherlight, Materials and Services and to ensure that the Website, Aetherlight, Materials and Services serve your needs in the most efficient manner possible.

By way of example the information provided when registering for an account is, as applicable, subsequently used:

(a) To allow access to the site;

(b) To create a unique account profile (for personalization, reward points, etc.);

(c) To notify/obtain consent from parents and to give them access to parental controls;

(d) For password reset purposes;

(e) To set up billing information for e-commerce; 

(f) For player safety, such as blocking IP addresses; and (g) For gameplay related features.

(g) To keep users (and the parents of children users) informed of their online activities;

 

7. What types of community or social features do we offer you on our site and how do we keep these areas safe?

Our community and social features include Chat.

In addition the following features are in place to provide a safe and enjoyable experience when using the Chat feature:

(a) Automated filtering;

(b) Live moderation; and

(c) User controls (blocking, reporting, etc.).

This functionality is provided by our great friends at communitysift.com - see their website for more information.

Our filtering and moderation activities for the Chat feature are designed to remove all or virtually all personal information from being posted or publicly shared by children users.

8. Do we offer other features on our site that ask you to provide information?

If you want to make use of any of the other following features you will also be asked to provide specific information:

(a) Newsletter sign-up form;

(b) Customer support;

(c) Episode purchases (see Section 10 below); and

(d) Social sharing functionality.

Whilst the Prologue will be free to play from March 2016, Registration is still required for all players and episodes. 

9. Do we collect information from you using cookies or other web technologies?

We may also place cookies on your computer.  Cookies are alphanumeric identifiers which are transferred to your computer’s hard drive through your web browser to enable us to recognise you whenever you access the Website and the Aetherlight and therefore better personalise your access of and use of the Website, Aetherlight, Materials and Services.  A cookie does not identify you personally but it does identify your computer.  The help portion of your browser’s toolbar should tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether.  You should note however that if you do not allow the use of cookies or do not wish to provide certain information to us, you may not be able to take full advantage of the Website, Aetherlight, Materials and Services.

We collect:

  • IP address and other header information (browser, operating system, etc.)

  • Website browsing statistics

To enable:

  • Website analytics/performance

  • Age screening purposes

  • Safety and security of site

 

10. Do we have e-commerce or advertisements on our site?

Game episodes and ancillary items will be sold through the Website. Parents can manage any ongoing season pass through parental controls.

11. With whom do we share your information?

Except as specifically provided for otherwise below and elsewhere in this Privacy Policy, we do not share your personal information with any independent third parties and personal information is not shared by us with independent third parties for their own marketing purposes.

Some information, including personal information, is shared with third party vendors who perform services on our behalf. More specifically we use the payment processing provider Xsolla and for our messaging and marketing to you we use Infinario and Mailchimp. We use Community Sift for the automated filtering of our Chat Feature, as noted above. 

All the the third party vendors we use are prohibited from using any information we share with them for their own purposes.

We may use and publish non-personal aggregate statistics and group data about those people who access or make use of any of the Website, Aetherlight, Materials or Services and their usage of any of the Website, Aetherlight, Materials or Services but none of this information will identify you personally.

Notwithstanding any other provisions of this Privacy Policy, to the greatest extent permitted at law, you agree that we may provide any personal information we collect about you to our associated entities, debt collection and credit reference agencies and any other parties we deem necessary in relation to providing you the Website, Aetherlight, Materials and Services and exercising any lawful right we, our associated entities or debt collection and credit reference agencies may have.

You also agree that to the greatest extent permitted at law we are entitled to disclose information we hold about you without your prior permission if we reasonably believe that such disclosure is necessary to:

(a) Meet legal requirements;

(b) Comply with legal process or help to maintain the law;

(c) Protect our rights or property or that of our associated entities; or

(d) Enforce this Privacy Policy or any other agreement that we may have with you.

 

12. How do we keep your information secure?

Unfortunately, no data transmission over the Internet can be guaranteed as totally secure.  Whilst we strive to protect such information, we do not warrant and cannot ensure complete security of any information which you transmit to us.  Accordingly, any information which you transmit to us is transmitted at your own risk.  Nevertheless, once we receive your transmission, we will take reasonable steps to preserve the security of such information. These steps include:

(a) Firewall-protected servers, encryption for credit card data (PCI compliant), login credentials for account access are all maintained through Amazon web services; and

(b) Manual safeguards include limited employee access to any information held.

 

13. Accessing Information

If you are an ‘Individual’ as that term is defined in the Privacy Act 1993 you are entitled to access any information which we may hold about you and we are obliged to provide this information to you as long as we have such information and such information can be readily retrieved.  You are also entitled to request that we correct any inaccuracies in any information which we hold about you.  We are entitled to charge you for the reasonable costs of retrieving, providing this information and as applicable correcting this information.

Under COPPA, parents have the ability to view their children’s personal information, request that we stop collecting or using their children’s personal information, or request the deletion of their children’s personal information, as applicable. 14. Amendments

We reserve the right to amend the Privacy Policy from time to time. If we do, we will post the changes here and update the effective date at the top of this Privacy Policy. Amendments will be effective immediately upon being placed on this Website. Your continued use of any of the Website, Aetherlight, Materials and Services following such amendments being placed on this Website will represent an agreement by you to be bound by the Privacy Policy as amended. Such amendments may include replacing this Privacy Policy with an entirely new Privacy Policy.  If we make material changes to this Privacy Policy or the handling of personal information, we will first notify you and obtain your prior consent (or the prior consent of a parent or legal guardian).
